Equibit Group Ltd. and Chris Horlacher have commenced a new action in the Ontario Superior Court of Justice against Nathan Wosnack and Ubitquity, LLC.

The Statement of Claim alleges that the Defendants registered and operated two impersonation websites—first at equibit.io and later at equibit.net—designed to be mistaken for Equibit’s own online presence. Both sites used Equibit’s name and branding. The first also deployed Horlacher’s name and likeness and falsely represented that he was its chief executive officer. The second falsely claimed to be published by a non-existent entity called “Equibit, Inc.” and asserted that the business it described was “Licensed and Regulated.”

Wosnack acquired detailed knowledge of Equibit’s name, branding, marketing materials, and proprietary information while serving as a director and as Chief Blockchain Officer of the company. The Claim alleges that he later used that knowledge, without licence or consent, to register the domains and to operate the impersonation sites through Ubitquity, a Delaware limited liability company that he wholly owns and controls.

The second site, equibit.net, remained operative at the time of filing and ranked first in search results for the primary branded term “Equibit,” above Equibit’s own documentation site. The Claim further alleges deliberate steps to conceal responsibility for the site, including maximum registrant privacy protection, Cloudflare shielding, and configuration changes designed to prevent further archival capture after an initial snapshot was taken.

The Plaintiffs seek compensatory and punitive damages, interim and permanent injunctive relief restraining further use of the Equibit name and mark, an order requiring transfer of the domain names equibit.io and equibit.net, an accounting of revenues, and a Norwich order directed at NameCheap, Cloudflare, Google, and other intermediaries to identify those responsible for the registration, control, operation, and promotion of the sites—including any records relating to curated search placement or preferential ranking.
