Closed apartment door with a court file, for the Ubitquity statement and the outstanding service on Nathan Wosnack.

Court File No. CV-26-00017856-0000
Equibit Group Ltd. and Chris Horlacher v. Nathan Wosnack and Ubitquity, LLC

On 18 September 2026, ten days after the Statement of Claim was issued, Ubitquity and Nathan Wosnack published a statement answering the pleading in public. It is not a Statement of Defence. No Defence has been filed. Wosnack has not been served.

The statement is here: Nathan Wosnack Equibit Lawsuit Fact Check & Official Ubitquity Statement.

What the Statement Says

The document is dated 18 September 2026 and issued from Austin, Texas, on behalf of Ubitquity, Inc., Ubitquity, LLC, and Nathan Wosnack. It cites Court File No. CV-26-00017856-0000. It denies the allegations as baseless, unfounded, and without merit. It calls the action performative, retaliatory, and frivolous. It says the authors will not litigate through the media, and then publishes a fact-check of the claim. It says a Statement of Defence will be filed in due course, and it reserves counterclaims for defamation, tortious interference, and abuse of process. It says there will be no further public comment.

A press statement is not a pleading. It is not served. It is not filed. It does not stop the time for a Defence from running, because that time has not started. A defendant answers a claim after he has been served with it.

What the Claim Pleads

The claim, issued 8 September 2026, is against Nathan Wosnack and Ubitquity, LLC. It alleges that the defendants registered and operated impersonation websites at equibit.io and equibit.net, designed to be mistaken for Equibit’s own, using knowledge Wosnack acquired as a director and as Chief Blockchain Officer. The plaintiffs seek damages, an injunction, transfer of the domains, an accounting, and a Norwich order. The issued pleading is Statement of Claim Filed Against Nathan Wosnack and Ubitquity, LLC.

The statement says Ubitquity, Inc. acquired Ubitquity, LLC and moved its headquarters to Austin in 2024, and that Wosnack is not the sole shareholder. The claim pleads that he wholly owns and controls the LLC used as the vehicle for the sites. That is a pleaded fact. Their press line is not a finding, and it is not a Defence.

He Has Not Been Served

Personal service has been attempted. Equibit has a current residential address for Nathan Wosnack in Scarborough Village, in Toronto. Process servers have attended. They have seen him in the building. He has not answered the door.

He has not been served. The Rebel.com letter of 17 September 2026, the day before this statement, was a complaint to Equibit’s registrar about the page that reports the pleading. It was notice. It was not service. The court decides any application under Rule 16.04 or 16.08. Until an order says otherwise, the claim is issued and the defendant has not accepted delivery of it.

A party who publishes a denial, names the court file, and promises a Defence in due course, while refusing to open the door to the process server, is not waiting on the court. He is avoiding the step that would require him to answer.

Place in the Equibit Lawsuit

Court File No. CV-26-00017856-0000 is the fourth of the Ontario actions. It concerns the impersonation sites and the use of Equibit’s name and of Horlacher’s name and likeness. The 18 September statement is a public response to that pleading. It is not a step in the court file. The service attempts, and the refusal to answer the door, are part of the record of how the defendants have met the claim.
